DMCA Policy

Unmistakable LLC dba Thank.FYI (“Company,” “we,” or “us”) respects the intellectual property rights of others and expects users of the Service to do the same.

This policy describes how we respond to claims of copyright infringement in accordance with the Digital Millennium Copyright Act (“DMCA”).

1. Reporting Copyright Infringement

If you believe that content hosted on or made available through Thank.FYI infringes your copyright, you may submit a written notification (“DMCA Notice”) to our designated copyright agent.

Your DMCA Notice must include the following information:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  2. Identification of the copyrighted work claimed to have been infringed
  3. Identification of the allegedly infringing material and information reasonably sufficient to locate it (such as a URL)
  4. Your name, mailing address, telephone number, and email address
  5. A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf

DMCA Notices that do not substantially comply with these requirements may not be processed.

3. Counter-Notification

If you believe that content you submitted was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification.

Your counter-notification must include:

  1. Your physical or electronic signature
  2. Identification of the material that was removed or disabled and the location where it appeared before removal
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification
  4. Your name, address, telephone number, and email address
  5. A statement that you consent to the jurisdiction of the federal court located in California and that you will accept service of process from the person who submitted the original DMCA Notice

Upon receipt of a valid counter-notification, we may restore the removed material unless the original complainant files a court action within the time period required by law.

4. Repeat Infringers

In accordance with the DMCA and our Terms of Service, we reserve the right to suspend or terminate accounts of users who are determined to be repeat infringers.

5. Good-Faith Requirement

Submitting false or misleading DMCA Notices or counter-notifications may result in legal liability. Please ensure that any claim or counter-claim is submitted in good faith and with appropriate authorization.

6. Relationship to Other Policies

This DMCA Policy is part of and incorporated into the Thank.FYI Terms of Service. Capitalized terms not defined here have the meanings set forth in the Terms of Service.
